Terms of Service

These Terms govern your access to and use of The Situational Report website, newsletters, and related services. Please read them carefully. By accessing the site or subscribing to any tier, you agree to be bound by these Terms.

01 Agreement to These Terms

The Situational Report ("SITREP," "we," "us," or "our") provides this website and its newsletter services subject to these Terms of Service. By accessing thesituationalreport.com, subscribing to a free or paid tier, or otherwise using the service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

The service is operated by Simon Peters, an individual doing business as "The Situational Report," a sole proprietorship located in Washington State. References to "you" mean the individual using the service.

02 What the Service Is

SITREP is a systematic market-intelligence newsletter. It applies a set of proprietary, rules-based scans to publicly available market data and delivers the results — scored and ranked setups, regime readings, market conditions, catalyst notes, and related factual context — on a scheduled basis. We offer the following tiers:

• Observer — a free weekly recap and limited preview.
• Operator — full daily intelligence at a recurring monthly price.
• Tactician — the same product as Operator, billed annually at a discount.

Features, schedules, scans, and tiers may change over time as the product develops.

03 Not Financial Advice

This is the most important provision in these Terms. SITREP is a publisher of systematic market information. We are not a registered investment adviser, broker-dealer, or financial planner, and we do not provide personalized investment advice. The content does not account for your individual financial situation, objectives, or risk tolerance.

Nothing in any brief, report, scan output, score, level, ratio, or other content constitutes a recommendation, solicitation, or offer to buy or sell any security or to adopt any trading strategy. Scores and levels are objective, rules-derived reference points — not signals to act. No fiduciary or advisory relationship is created between you and SITREP by your use of the service. You should consult a licensed financial professional before making any investment decision.

04 Trading Risk Disclosure

Trading and investing involve substantial risk of loss and are not suitable for every person.

You may lose some or all of your capital. Past performance — including any historical outcomes, hindsight performance records, or hit rates we may publish — is not indicative of and does not guarantee future results. Any historical record we publish reflects how a security moved after it was surfaced; it does not represent the return of any actual or recommended trade, and it does not predict the behavior of any future signal. You accept full responsibility for your own decisions and their outcomes.

05 Eligibility

You must be at least 18 years old and able to form a binding contract to use the service. By subscribing, you represent that you meet these requirements and that the information you provide is accurate.

06 Subscriptions, Billing & Cancellation

Paid subscriptions are processed by our third-party payment processor, Stripe. We do not store your full payment-card details. By subscribing to a paid tier you authorize recurring charges as described at checkout.

Auto-renewal

Paid subscriptions renew automatically — monthly for Operator, annually for Tactician — at the then-current price, until you cancel. You will be charged at the start of each billing period unless you cancel before it begins.

Cancellation

You may cancel at any time through your Stripe billing portal or by contacting us. Monthly subscriptions remain active through the end of the current billing cycle and are not renewed thereafter. Annual subscriptions remain active for the remainder of the paid year.

Refunds

Monthly subscriptions are not refunded for the current period but will not renew once cancelled. Annual subscriptions are non-refundable; you retain full access for the remainder of the term. We may make exceptions at our sole discretion.

Price changes

We may change subscription prices. Any change will apply to your next billing period, and we will provide notice where required by law.

07 Intellectual Property

The site, the newsletters, the scan methodology, scores, the "SITREP" and "The Situational Report" names and marks, the radar logo, and all related content are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to access and use the content for your own individual use.

You may not copy, redistribute, resell, republish, forward in bulk, scrape, or create derivative products from the briefs or their contents without our prior written permission. Sharing your subscription, login, or paid briefs with non-subscribers is prohibited.

08 Acceptable Use

• Do not use the service for any unlawful purpose or in violation of these Terms.
• Do not attempt to access, scrape, or harvest the service by automated means without permission.
• Do not resell, sublicense, or commercially exploit the content.
• Do not interfere with or disrupt the service or its infrastructure.

09 Third-Party Services & Links

The service relies on and may link to third parties — including Stripe (payments), Mailchimp (email delivery), Plausible (analytics), GitHub Pages (hosting), Zapier (automation), and charting tools such as TradingView. We do not control these third parties and are not responsible for their content, services, or practices. Your use of them is governed by their own terms and policies.

10 Disclaimer of Warranties

The service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the content will be accurate, complete, timely, error-free, or uninterrupted, or that any data source, scan, or score will perform as expected. Market data is sourced from third parties and may contain errors or delays.

11 Limitation of Liability

To the fullest extent permitted by law, SITREP and its operators will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any trading or investment losses, lost profits, or lost data, arising out of or relating to your use of the service. To the extent any liability is found, it will not exceed the amount you paid us in the twelve months preceding the claim.

12 Indemnification

You agree to indemnify and hold harmless SITREP and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your trading or investment decisions, or your violation of these Terms.

13 Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using the service at any time. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

14 Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent version. Material changes will be communicated where appropriate. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.

15 Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in King County, Washington, and you consent to their jurisdiction, except where applicable law provides otherwise.
